Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and
Ham Technologies, LLC ("we", "us", the developer of the Skyladder application
identified by com.hamtechnologies.skyladder) governing your use of the
Skyladder mobile app ("Skyladder", "the app"). By downloading, installing, or using
Skyladder, you agree to these Terms. If you do not agree, do not use the app. Contact:

1. What Skyladder is (and is not)
Skyladder is a client application that lets you connect your device to VPN/proxy servers that you provide from a third‑party VPN provider. Skyladder does not include, host, sell, or operate any servers, subscriptions, or network exit points, and it does not itself provide a VPN service or bandwidth. It is a tool for using a service you obtain elsewhere.
2. Eligibility
You must be old enough to form a binding contract in your jurisdiction (and at least 13, or the higher minimum age required where you live) to use Skyladder. By using the app you represent that you meet this requirement.
3. Licence
Subject to these Terms, we grant you a limited, personal, non‑exclusive, non‑transferable, revocable licence to download and use Skyladder on devices you own or control, for your own personal, non‑commercial use, in accordance with the applicable app store's terms. You may not:
- copy, modify, or create derivative works of the app except as permitted by the open‑source licences of its components (see Section 10);
- reverse engineer, decompile, or disassemble the app except to the extent this restriction is prohibited by law or permitted by an applicable open‑source licence;
- rent, lease, lend, sell, redistribute, or sublicense the app;
- remove or alter any proprietary notices;
- use the app in any way that violates these Terms or applicable law.
4. Your servers, subscriptions, and credentials
You are solely responsible for the subscriptions, servers, and credentials you add to Skyladder, and for obtaining them lawfully from a provider you trust. We do not supply, endorse, verify, or control any provider or server. Your relationship with your provider — including payment, data allowances, availability, logging, and privacy — is governed by your agreement with that provider, not by us. You are responsible for keeping your credentials and any backup passphrase secure; a backup passphrase cannot be recovered by us or anyone else.
5. Acceptable use
VPN and proxy technology is not legal or permitted everywhere, and its legality can depend on where you are and how you use it. You are responsible for ensuring that your use of Skyladder and of any server you connect through complies with all laws, regulations, and third‑party terms that apply to you. You agree not to use Skyladder:
- for any unlawful, fraudulent, or malicious purpose;
- to infringe the rights of others, including intellectual‑property or privacy rights;
- to gain unauthorised access to any system, network, or data;
- to distribute malware or engage in attacks, spam, or abuse;
- in violation of the laws of your country or of any country whose services you access; or
- in violation of the terms of your VPN provider or of any network you use.
We may not monitor your use (and generally cannot see your traffic), but a violation of this section is a breach of these Terms.
6. Third‑party services and content
Skyladder connects to and interoperates with third‑party services you choose — including your VPN provider, the servers you select, and the connectivity/IP and DNS endpoints described in the Privacy Policy. We are not responsible for third‑party services, servers, or content, for their availability, performance, security, or lawfulness, or for any data they collect. Your use of them is at your own risk and subject to their terms.
7. No warranty
Skyladder is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. To the maximum extent permitted by law, we do not warrant that: the app will be uninterrupted, timely, secure, or error‑free; any connection will succeed, stay connected, or achieve any particular speed; the app will conceal your identity, evade any filtering or restriction, or protect you in any particular way; or that any defect will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
8. Limitation of liability
To the maximum extent permitted by law, in no event will Ham Technologies, LLC or its officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) Skyladder — even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to Skyladder will not exceed the greater of the amount you paid us for the app (if any) or USD 10. Some jurisdictions do not allow the limitation or exclusion of certain liability, so some of the above may not apply to you.
9. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Ham Technologies, LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of Skyladder, your violation of these Terms, or your violation of any law or third‑party right.
10. Open‑source components
Skyladder incorporates open‑source software, including the Xray‑core / libXray proxy engine, licensed under the Mozilla Public License 2.0 (MPL‑2.0), and other components under permissive licences. Your use of those components is governed by their respective licences, which are acknowledged in the app's Licensing screen and prevail over these Terms to the extent of any conflict for those components.
11. App‑store terms
If you obtained Skyladder through the Apple App Store or Google Play, your use is also subject to that store's terms. Where those terms require specific provisions (for example Apple's "Licensed Application End User License Agreement" and its third‑party‑beneficiary rights, or Google Play's terms), those provisions apply and, to the extent required, prevail.
12. Termination
These Terms apply until terminated. Your licence ends automatically if you breach them. You may end them at any time by uninstalling the app. Sections that by their nature should survive termination (including Sections 4–9) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide notice within the app or on this website. Your continued use of Skyladder after an update means you accept the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict‑of‑laws rules. Any dispute arising out of or relating to these Terms or the app that is not resolved informally will be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits any non‑waivable statutory rights you may have as a consumer.
